Evans v The Queen (2007) 235 CLR 521

Facts: An armed robbery was caught on CCTV footage, showing the offender in overalls, sunglasses and a balaclava. Multiple witnesses gave evidence about his particular gait and the way he asked for “serious cash”. The prosecution asked the judge to order a “view” of the defendant (D) wearing the same clothes, walking around the court and saying “serious”.
