Facts: Defendant (D) was charged with causing damage to a house by setting it on fire. D said “I must have done it, no one else there”. She was found outside covered in soot, disorientated and not understanding what happened. A doctor was called who said she was cooperative, quiet and suicidal (history of attempts), had a drug tendency and was using alcohol heavily and she was brain damaged. She was not fit to be interviewed.
