R v Stewart (2001) 124 A Crim R 371

Facts: Defendant (D) (appellant) charged with aggravated break, enter and stealing from a dwelling. The prosecution’s (Pr) ‘case was that D committed the crime with a co-offender, Braddick (B), who pleaded guilty and gave evidence against D to reduce his own sentence. D appealed on the basis that an unreliability direction should have been given.
