Smith v The Queen (2001) 206 CLR 650

Facts: Smith (defendant; D) was convicted of a bank robbery. The bank security cameras captured him outside the bank but the quality wasn’t great. The prosecution's case theory was that he was keeping a lookout while co-offenders took the money. A fact in issue was whether D was the person in the CCTV. Two police officers (POs) gave evidence that they knew D and that he was the person in the photos. D appealed on the ground the evidence given by POs was irrelevant.
